Protecting Your Marital Property

The equitable distribution of marital property is based on both what you brought into the marriage and what was accumulated during the marriage. We can help you understand what rights you have when considering the future of your home, car, and other assets. It is important to know that you can protect the assets that you brought into the marriage. We will help you make sure you get credit for your pre-marital interests.

Two Types of Divorce

Limited Divorce - A Limited Divorce does not require a significant separation period and serves to formalize the marital separation of the parties. While a Limited Divorce does not end the marriage or divide property, it allows the Court to step in and determine matters related to support, custody, visitation and use and possession of the marital home on a temporary basis.

Absolute Divorce - An Absolute Divorce finalizes the dissolution of the marriage and makes a final determination as to property distribution and all other matters arising from the marriage, to include but not limited to, custody, visitation and support. In most instances, an Absolute Divorce requires the parties to have lived separate and apart for at least one year.

Grounds for Divorce

Limited Divorce - A Limited Divorce can be granted on the following grounds:

  • Mutual and Voluntary Separation
  • Desertion
  • Constructive Desertion (this means that one spouse's behavior was such that it forced the other party to leave the marital home)
  • Cruelty of Treatment
  • Excessively Vicious Conduct

Absolute Divorce: An Absolute Divorce can be granted on the following grounds:

  • Adultery
  • Mutual and Voluntary Separation
  • Desertion
  • Constructive Desertion
  • Cruelty of Treatment
  • Excessively Vicious Conduct
  • Insanity
  • Conviction of a Crime
  • Two Year Separation

Child Custody and Support

One of the most important factors in your divorce is the future of your children. From child custody to support and visitation, we can help you understand your options and how your children's future affects the distribution or property.
