A judge may consider several factors that could affect how your child is raised. A judge’s goal is to give your child the best possible upbringing. When considering a child’s best interests, the following may affect a judge’s decision:

  • The relationship between the parents and their child
  • The ability for the parents to work together
  • A child’s physical and mental needs
  • Each parent’s ability to provide for their child’s needs
  • Each parent’s income and work schedule 
  • Each parent’s physical and psychological conditions
  • Each parent’s history of criminal activity, drug use, abuse, abandonment or neglect

A judge will consider all of the information given to them before deciding what is best for a child.
